I remember a miserable day in 2010. “Dan,” a health coach and close friend of mine, had just been reported to the California Board of Behavioral Sciences (CABBS), accused of practicing psychology without a license.
The CABBS is obliged to investigate every complaint it receives. My friend was in a panic. He suddenly found himself having to hire a lawyer, and find out if what he’d done was really legally wrong. When the attorney and I looked at Dan’s website, we found all kinds of “red flag” language.
“I didn’t see it coming.”
Those were Dan’s words when he got hit with the CABBS investigation. At first he felt angry and outraged, feeling like he’d been unfairly targeted by a big state organization. But I and his attorney patiently explained to him that he had indeed crossed ethical “red lines” by the way he described his services.
With nothing but the best of intentions, Dan had innocently and unintentionally gone where he didn’t belong. Ignorance is not bliss. And ignorance of ethical boundaries is no defense against crossing them. Once he understood this, Dan cleaned up the offending language on his web site.
As a respected researcher, I wrote a letter to CABBS defending Dan, and explaining the research behind the work Dan and I do. Eventually, he was cleared of any wrongdoing, and with a cleaned-up web site, resumed his coaching practice.
However, the legal bills and webmaster charges left Dan $20,000 in debt. That’s an expensive and unpleasant way to get an education in professional ethics.
